Privacy policy and protection of personal data

ARTICLE 1 - Definitions

  • "Platform" means the infrastructures developed by Hippocratic Generation, Unipessoal LDA, containing data of various types, in particular texts, sounds, still or animated images, videos, databases, intended to be consulted and accessible on the web and mobile platforms of VITA NATURALIS;
  • "Personal data", "special categories of data", "processing" means any information relating to an identified or identifiable natural person ("data subject"); an "identifiable natural person" is considered to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements of his or her physical, physiological, genetic, mental, economic, cultural or social identity;
  • "Controller" means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of processing; where the purposes and means of processing are determined by Union or Member State law, the controller may be designated or the specific criteria for designation may be provided for by Union or Member State law;
  • "Recipient" means a natural or legal person, public authority, agency or any other body to whom personal data are disclosed, whether or not a third party. However, public authorities which may receive personal data in the framework of a specific investigative task under Union or Member State law shall not be considered as recipients; the processing of such data by the public authorities concerned shall comply with the applicable data protection rules according to the purposes of the processing;
  • "Authorised third party" means any natural or legal person, public authority, service or body other than the data subject, the controller, the processor and persons who are placed under the direct authority of the controller or the processor and are authorised to process the personal data;
  • "Data subject" means a natural person to whom the data subject of the processing relates;
  • "Processing of personal data" shall mean any operation or set of operations which is performed, whether or not by automatic means, upon personal data or sets of data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

ARTICLE 2 - Scope of application

The purpose of this personal data protection policy is to inform data subjects of how their personal data is collected and processed by Hippocratic Generation, Unipessoal LDA, as well as all their rights arising from the EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, called "RGPD".

ARTICLE 3 - Identity of the controller

Personal data will be collected by Hippocratic Generation, Unipessoal LDA, a limited liability company, registered in the Lisbon Trade Register, with the number NIPC: 516643037, with headquarters at Rua Irmãos Roby, nº 208, 4700 226 Braga (Sé), represented by Sandrine FERREIRA, in her capacity as President and Director of the publication.

What data is collected?

Our company collects the following data and information only in the "Profile" section:

  • Personal information: first name, last name, email address
  • You can add a profile photo, but this option is optional.
  • Pictures, Videos

ARTICLE 4 - Processing of personal data

As part of the operation of the Hippocratic Generation platforms, Unipessoal LDA is likely to collect data about you.

This data will be processed for the purposes foreseen at the time of collection, namely:

  • the correct operation of the Platforms in terms of their functionalities;
  • the operations related to the management of customers, the search for customers, the transfer, rental or exchange of the customer file and the search for customers, as well as the compilation of statistics on the frequency of use of the Platforms
  • the performance of any contract to which the User may be a party
  • the management of sponsorship activities
  • the presentation of specific advertising on the basis of the data collected during the creation of your account.

Should the data be used for other purposes, Hippocratic Generation, Unipessoal LDA undertakes to obtain the consent of the data subject prior to the processing and to specify the purpose(s) of the processing in advance.

The mandatory or optional nature of the data to be provided by the data subject will be indicated by an asterisk on the data collection forms.

They will be informed of the possible consequences of failing to respond.

In any case, Hippocratic Generation, Unipessoal LDA undertakes to process the data collected in accordance with the provisions of Law no. 196/2003.

ARTICLE 5 - Rights of the data subject

It is recalled that data subjects have the right of access, rectification, opposition, cancellation, restriction and portability of their personal data, except in cases where the processing is carried out pursuant to a legal obligation.

These rights may be exercised, in accordance with the Privacy Code, by sending a simple request by e-mail to the following address: info@hippocraticgeneration.com.

ARTICLE 6 - Anonymisation

The data collected will be kept in a form that allows the identification of the persons concerned for as long as necessary for the purposes for which they were collected and processed.

Hippocratic Generation, Unipessoal LDA will anonymize the data upon completion of the purpose of treatment or upon termination of the user account, unless legal or regulatory provisions to the contrary.

In this case, the data will be kept in accordance with the applicable retention periods.

ARTICLE 7 - Transmission of personal data

The personal data collected on the platforms are exclusively reserved to Hippocratic Generation, Unipessoal LDA, which may need to communicate the personal data of the persons concerned in order to provide assistance, carry out satisfaction surveys and statistical studies. 

The communication of personal data will be carried out in accordance with the anonymisation rules mentioned in article 6 "Anonymisation". 

The recipients of your data are within the limits of their respective attributions:

  • Authorised personnel of the Marketing, Sales, Customer Relations and Prospecting, Administration, Logistics and IT Departments and their line managers;
  • The authorised personnel of the control departments (auditors, internal control departments, etc.);
  • The authorised personnel of Hippocratic Generation, Unipessoal LDA's subcontractors involved in the processing of your personal data, provided that the contract signed between them and Hippocratic Generation, Unipessoal LDA refers to the obligations incumbent on the subcontractors. Suppliers with regard to the protection of data security and confidentiality (Article 28 of the GDPR) shall specify, in particular, the security objectives to be achieved.

They may also be recipients of the data:

  • Partners, external companies or subsidiaries of the same group of companies, subject to prior authorisation in accordance with article 4.11 of the GDPR;
  • Bodies, legal assistants and bailiffs in the context of their debt collection mission.

In addition, Hippocratic Generation, Unipessoal LDA reserves the right to transfer the personal data of data subjects in order to comply with its legal obligations, in particular when required to do so by court order.

Hippocratic Generation, Unipessoal LDA informs you that your data may be transferred outside the European Union.

If this is the case, Hippocratic Generation, Unipessoal LDA undertakes not to transfer data outside the European Union without the prior written consent of the client and provided that the recipient country provides adequate safeguards and that the persons concerned have enforceable rights and effective remedies, in accordance with Article 46 of the RGPD.

ARTICLE 8 - Sponsorship and Prospecting

You may be invited to join the site by a private contact (sponsorship).

In this case, you will receive a message informing you of the identity of the sponsor.

The sponsor's data can only be used once: to send you the commercial offer, press article or advertisement proposed by the sponsor.

Hippocratic Generation, Unipessoal LDA may keep the sponsor's data to send you other communications only if you have given your express consent.

If you are a user, you may at any time request to be removed from the list of email addresses used for prospecting purposes by sending an email, followed by a confirmation of receipt, to the following address: info@hippocraticgeneration.com.

ARTICLE 9 - Security

In accordance with articles 34 and 35 of law n°78-17 of 6 January 1978, modified on 6 August 2004, and article 32 of the RGPD, Hippocratic Generation, Unipessoal LDA adopts all the technical and organisational measures necessary to guarantee the security and confidentiality of the personal data collected and processed, namely to prevent their distortion, deterioration or disclosure to unauthorised third parties, guaranteeing a level of security appropriate to the risks associated with the processing and the nature of the data to be protected, taking into account the level of technology and the cost of implementation.

ARTICLE 10 - Applicable law and dispute resolution

They are governed by Portuguese law.

If any provision of these terms and conditions is held to be invalid or is declared so by a law, regulation or final decision of a competent court, the other provisions shall retain all their force and scope.

In the event of any difficulty in the interpretation or application of these terms and conditions, the parties shall endeavour to resolve their differences amicably, in which case the parties undertake to seek mediation before proceeding. In the event of persistent disagreement, any dispute arising from the execution or interpretation of these conditions shall be submitted to the jurisdiction of the Courts of the City of Braga.
